PRIVACY POLICY

1. INFORMATION FOR USERS

 

This Privacy Policy expresses the commitment of The Padel Lab GmbH, (hereinafter, The Padel Lab) with regard to the privacy and protection of the data that we process, granting Users the following guarantees, among others: (i) they may at any time exercise the rights they enjoy in accordance with the applicable regulations; (ii) we will comply with the obligation of secrecy and confidentiality regarding the personal data gathered, which we will not communicate to third parties without their consent; (iii) we have adopted the necessary technical and organisational measures. 

The technical and organisational measures we adopt are appropriate, and comply with the provisions of Regulation (EU) 2016/679, of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data, and on the free movement of such data, and repealing Directive 95/46/EC (the GDPR), and the Spanish Personal Data Protection and Guarantee of Digital Rights Act 3/2018, of 5 December 2018 (the Data Protection Act).

The Padel Lab is the CONTROLLER with regard to the processing of the personal data of USERS, and informs them that these data will be processed in accordance with the provisions of the Regulation on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter, the GDPR), and Spanish Personal Data Protection and Guarantee of Digital Rights Act 3/2018, of 5 December 2018 (hereinafter, the Data Protection Act).

How do we process your personal data?

We are committed to properly processing your personal data, and will therefore always process them: In a lawful, fair and transparent manner. (i) For specific, explicit and legitimate purposes. (ii) In an adequate, relevant manner, restricted only to the necessary processing for the purpose in question. (iii) In accurate and up-to-date form. (iv) For as long as necessary to fulfil the purpose for which they were gathered. (vi) In a proper and confidential manner.

 

What personal data do we process?

The categories of personal data that we collect within the context of our services are in all cases as necessary and relevant for the processing thereof: (i) Personal contact data: full name, date of birth, email address and other identification details. (ii) Invoicing data to provide the service with the User. (iii) Connection and website data. (iv) Social media identification data. In any event, any processing performed will be solely in order to interact with Users in the implementation of the published content and/or any prize draws or promotions organised. 

 

What will we process your personal data for?

Personal data may processed by the data controllers for the following purposes: (i) Administer and perform the contracts signed with the Users. (ii) Communication with Users to address the queries raised. (iii) Administer participation by the User in any competitions, prizes or prize draws organised by The Padel Lab. (iv) Sending of commercial, information and/or courtesy communications. (v) Connection and cookies data. Information regarding the Website connection, such as cookies or IP address. For further information about cookies, please consult our Cookies Policy. (vi) Social Media. The Padel Lab has a profile on Facebook, Instagram and LinkedIn for commercial information purposes. It will use said social media platforms to access any personal data that each User has provided to the platform, which will in all cases be processed for the purpose of addressing queries, questions or other activities inherent in social media, the legal basis being the consent of the User. The Padel Lab does not obtain social media data for marketing purposes.

 

Why may we process your personal data?

The Padel Lab will process the Users’ personal data in accordance with any form of legal basis established in Article 6 of the GDPR as follows: (i) With the consent of the User, such as the sending of communications about the latest promotions or news. (ii) Performance of a contract to which the User is party: development and fulfillment of a contract between the two parties, such as the purchase of products. (iii) In the legitimate interest of the CONTROLLER: to perform marketing studies, statistical analyses, etc. (iv) By legal obligation.

 

How long will we store your personal data for?

They will be stored for no longer than necessary in order to maintain the purpose of processing, or until the expiry of any statutory limitation periods requiring the data to be held in safekeeping, and once the data are no longer required for this purpose they will be erased using appropriate security measures so as to guarantee anonymization or complete destruction of the data.

 

Who do we provide your personal data to?

There are no plans for any communication of personal data to third parties, unless for the development and execution of the purposes of processing it should be necessary to communicate data to our communication-related service providers, with which The Padel Lab has signed non-disclosure and data processing contracts as required by the privacy regulations in force. Your personal data will only be transferred where necessary to offer and provide you with the service, specifically: (i) IT service providers, for the maintenance and development of the services that we offer. (ii) Service providers connected with marketing, advertising or social media, that assist us in marketing and advertising actions and the analysis of the services we offer. As indicated previously, your personal data may also be communicated to the relevant authorities, or in accordance with the applicable laws and regulations.

 

What are your data protection rights?

You may, free of charge and to the extent that the legal demands are fulfilled, exercise the following rights: (i) Right of access: You have the right to obtain information about the personal data concerning you that we are or are not processing, and if so, to access the data. If you so request, we will provide you with a copy of the personal data that we are processing. (ii) Right of rectification: You have the right to rectify your personal data if they are imprecise, or to have any incomplete data completed. (iii) Right of erasure: You may request the erasure of your data when, among other circumstances, they are no longer needed the purposes for which they were collected or otherwise processed. (iv) Right to restriction of processing: You have the right to restrict the processing of your data, in certain circumstances established by the data protection regulations. (v) Right to data portability: You have the right to receive your personal data in a structured, commonly used, machine-readable format, and to transfer them to another entity. (vi) Right of opposition: In certain situations, you may oppose a particular type of processing for reasons connected with your individual situation, which includes profiling. You may at all times oppose the processing of your personal data for direct marketing purposes. (vii) Right to revoke your consent: You may at all times withdraw any consent that you gave us for any processing, although this withdrawal will not affect the lawfulness of processing based on the consent previously given. (viii) Right to file a grievance with the supervisory authority (www.aepd.es) if you believe that the processing does not comply with the regulations in force.

2. MANDATORY OR VOLUNTARY NATURE OF INFORMATION PROVIDED BY USERS

By marking the corresponding boxes and entering data in those fields marked with an asterisk (*) in the contact form, or presenting data using downloaded forms, Users explicitly, freely and unequivocally accept that their data are required in order for their request to be addressed by the service provider, the inclusion of data in all other fields being voluntarily. Users guarantee that the personal data provided to The Padel Lab are accurate, and accept their responsibility to serve notice of any modification thereto.  

The Padel Lab informs USERS that all data requested via the website are required, since they are necessary in order to provide an optimal service. If not all data are provided, no guarantee is given that the information and services provided will fully comply with your needs.

3. SECURITY MEASURES

In accordance with the provisions of the personal data protection regulations in force, The Padel Lab complies with all provisions of the GDPR and Data Protection Act for the processing of the personal data for which it is responsible, and manifestly does so in accordance with the principles set out in Article 5 of the GDPR. The data are therefore processed in a lawful, fair and transparent manner with regard to the data subject, and are appropriate, relevant and limited to the data required in connection with the purposes for which they are processed.

The Padel Lab guarantees that it has implemented appropriate technical and organisational policies to apply the security measures established by the GDPR and the Data Protection Act in order to protect the rights and freedoms of USERS, and has given them appropriate information allowing them to exercise these rights.

The Padel Lab may change this Policy at any time, and will declare the date when it was last updated. In the event of significant changes, it will attempt to alert Users wherever possible.
